Welcome to Discreet. By accessing or using our platform, you agree to be bound by these terms of service. Please read them carefully before creating an account or using any features of the service.

1. Acceptance of Terms

By creating an account, accessing, or using Discreet (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Discreet (“we,” “us,” or “our”).

2. Description of Service

Discreet is a two-sided talent marketplace that connects employed professionals (“Talent”) with hiring companies (“Companies”). The platform enables anonymous professional discovery, where talent profiles are visible to companies without revealing identifying information until the talent user explicitly consents.

Key features of the Service include:

  • Anonymous talent profiles with skills-based matching
  • Company-to-talent pitching system
  • Mutual reveal process controlled by the talent user
  • Built-in pipeline management for the hiring process
  • Analytics and market intelligence tools

3. Account Registration & Eligibility

To use Discreet, you must:

  • Be at least 18 years of age
  • Be a currently employed professional (for talent accounts) or an authorized representative of a hiring company (for company accounts)
  • Provide accurate and truthful information during registration
  • Verify your identity through a valid work email address
  • Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Talent User Terms

  • Anonymity: Your profile is anonymous by default. Your name, employer, and work email are never displayed to companies unless you explicitly consent to a reveal.
  • Profile accuracy: You agree to provide truthful information about your skills, experience, and career history. Misrepresentation may result in account termination.
  • Reveal consent: The reveal process is always initiated by you. When you accept a company's pitch, you consent to sharing your identifying information with that specific company.
  • Employer blocking: You may block your current employer from viewing your profile. We will make commercially reasonable efforts to enforce this block, but cannot guarantee absolute prevention.

5. Company User Terms

  • Pitching guidelines: Pitches must be genuine, professional, and represent real open positions at your company. Spam, misleading, or automated pitches are prohibited.
  • No de-anonymizing: You agree not to attempt to identify anonymous talent profiles through external means, cross-referencing, or any method outside the platform's reveal process.
  • Subscription required: Access to talent reveals requires an active subscription. Free accounts receive a limited number of complimentary reveals.
  • Data use: Information obtained through reveals may only be used for legitimate hiring purposes. Sharing, selling, or misusing talent data is strictly prohibited.

6. Subscription Plans & Billing

Company accounts may subscribe to one of the following plans:

  • Starter: Suitable for small teams beginning to hire through Discreet.
  • Growth: Expanded access for growing companies with active hiring needs.
  • Scale: Full-featured plan for high-volume recruiting teams.

All new company accounts receive 5 free reveals before a subscription is required. Payments are processed securely through Stripe. Subscriptions renew automatically unless cancelled. Refunds are handled on a case-by-case basis.

7. Privacy & Anonymity Commitments

We make the following platform-level commitments:

  • Talent identities are never shared without explicit consent
  • Work emails are used solely for verification and are never displayed
  • Employer blocking is enforced at the database level
  • We do not sell user data to any third party
  • Analytics data is aggregated and anonymized

8. Prohibited Conduct

You agree not to:

  • Create fake or misleading profiles
  • Scrape, crawl, or harvest data from the platform
  • Harass, threaten, or discriminate against other users
  • Attempt to circumvent anonymity protections or de-anonymize users
  • Use the Service for any unlawful purpose
  • Interfere with the platform's security or infrastructure
  • Share login credentials or transfer your account
  • Use automated tools to interact with the Service without authorization

Violation of these terms may result in immediate account suspension or termination.

9. Intellectual Property

The Discreet platform, including its design, code, matching algorithms, branding, and content, is owned by Discreet and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of the content you provide (profile information, pitches, etc.) but grant us a limited license to use, display, and process it as necessary to operate the Service.

10. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Matches or pitches will result in successful hires
  • All user-provided information is accurate

To the maximum extent permitted by law, Discreet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time through your settings or by contacting us. We may suspend or terminate your account if you violate these Terms, with or without prior notice. Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice through the platform or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
